“The district court clearly recognized the gravity of dismissing the case and accordingly provided a thorough analysis, amply supported by factual findings,” Judge Johnnie Rawlinson wrote in Tuesday's 6-page opinion. In dismissing the case in Nevada, Dorsey sanctioned Stovall for “bad faith,” saying he had improperly attempted to use documents that were leaked or stolen in a cyberattack to pursue Mayorga’s case. Mayorga's lawsuit claimed conspiracy, defamation, breach of contract, coercion and fraud. By the time Dorsey threw out the case, Stovall claimed Mayorga should receive for more than $25 million in damages. “The district court did not abuse its discretion when it found that a case-terminating sanction was appropriate,” the ruling said.

The creators of the hit crime drama "Better Call Saul" on Monday won the dismissal of a defamation and trademark infringement lawsuit by Liberty Tax Service for depicting a shady fictional tax firm that appeared to resemble its own. Gardephe said Liberty Tax offered no "particularly compelling" allegations that viewers would be confused into thinking Sweet Liberty was one of its more than 2,500 offices. "Better Call Saul" starred Bob Odenkirk as Saul Goodman, a corrupt lawyer also known as Jimmy McGill. Peter Siachos, a lawyer for Liberty Tax, said his client will explore its legal options, including an appeal or refiling the lawsuit in a state court. Both said their use of Sweet Liberty was protected by the U.S. Constitution's First Amendment.

A forensics expert hired to examine the gun that discharged while Alec Baldwin was rehearsing with it on the set of the film “Rust” in New Mexico, killing the movie’s cinematographer, has issued a new report that determined the actor must have pulled the trigger, a conclusion at odds with his account. Since the fatal shooting of the cinematographer, Halyna Hutchins, in October 2021, Mr. Baldwin has said that he had pulled the hammer back and let it go just before the gun discharged, maintaining that he did not pull the trigger. Prosecutors have been skeptical of his claim that he did not pull the trigger, and in January Mr. Baldwin was charged with involuntary manslaughter in connection with the case. A new set of prosecutors dismissed the charges against him in April, saying new evidence suggested that the gun Mr. Baldwin had been rehearsing with that day might have been modified, potentially making an unintentional discharge easier. The prosecutors said at the time that they would consider refiling charges against the actor after a new examination of the gun.

Bitcoin fell 2% on Friday after the SEC reportedly said recent ETF applications are inadequate. BlackRock and Fidelity recently filed for bitcoin spot ETFs, boosting hope that an approval was near. But Friday's report suggested that approval of a spot bitcoin ETF still faces some hurdles, even after the regulatory agency approved a 2x leveraged bitcoin futures ETF. The price of bitcoin had surged above the $30,000 level earlier this month after the BlackRock and Fidelity filings reignited the race for the first spot bitcoin ETF. Part of the SEC's concern with the latest bitcoin ETF applications was that they didn't provide enough information about the "surveillance-sharing agreement" they would implement to ensure that the ETF was not susceptible to fraud.

Employees at Star Garden Topless Dive Bar in North Hollywood California voted to unionize. Employees including dancers, entertainers, and DJs want to be represented by the Actors Equity Association. They will become the first union of strippers in the US in a decade. "I'm excited that all of my beautiful coworkers will finally have a seat at the table and a voice to discuss safety and other issues," Sinder, a Star Garden dancer told CNN. Insider reached out to Star Garden, the NLRB, Actors Equity Association, and Stripper Strike Noho but did not immediately hear back outside of regular working hours.
Johnson & Johnson (JNJ) before-the-bell Tuesday reported a strong first quarter, with sales up more than 5.5% and earnings eking out an annual increase. We're leaning toward the second reason: Management's 2025 Pharmaceutical sales target because J & J's results would have exceeded estimates even without strong vaccine sales. On the post-earning call, management said they see Pharmaceutical sales in 2025 closer to $57 billion than the $60 billion forecast two years ago. While we understand the Street's desire to dig into the 2025 Pharmaceutical sales dynamic, we believe weakness in the stock represents a buying opportunity. That's thanks to increased prices and strong consumer demand, the combination of which speaks to the pricing power of the Johnson & Johnson, soon-to-be Kenvue, brand.
The European Commissioner for the economy, Paolo Gentiloni, has hailed the EU's swift transition away from its dependency on Russian gas and said next winter will be less challenging. "We were expecting a terrible winter, a winter of recession and problems with energy supplies, blackouts," he told CNBC's Joumanna Bercetche in Washington, D.C. on Wednesday. "We didn't have recession and we were able to go out from dependency from Russian gas in eight months. He said the EU would be refiling storage from the end of April without Russian gas and said it was important to diversify pipelines, noting increased Chinese demand following its lockdown reopening may bring liquefied gas prices up. "More optimistically, the big, big challenge was last winter, next winter will also be challenging but we already know we were able to do something amazing," Gentiloni said.
[1/2] A bottle of Johnson and Johnson Baby Powder is seen in a photo illustration taken in New York, February 24, 2016. In a court filing Tuesday, lawyers representing a creditors committee of talc plaintiffs said they recently became aware of discussions about a second J&J subsidiary bankruptcy. The J&J subsidiary that was to absorb liability for the talc cases, LTL Management, declared bankruptcy almost immediately after it was created. Andy Birchfield, a plaintiffs' lawyer at law firm Beasley Allen, said on Tuesday that claims “could easily be resolved if Johnson & Johnson would stop playing games and abusing the bankruptcy court process." How the J&J subsidiary might square such a move with the appeals court ruling remained unclear.
A federal judge on Thursday imposed nearly $1 million in sanctions on former President Donald Trump and his lawyer for filing a since-dismissed "frivolous" lawsuit against Hillary Clinton and many others, which had claimed they tried to rig the 2016 presidential election in her favor by smearing Trump. Middlebrooks in his order Thursday noted that "Mr. Trump is a prolific and sophisticated litigant who is repeatedly using the courts to seek revenge on political adversaries." "He knew full well the impact of his actions ... As such, I find that sanctions should be imposed upon Mr. Trump and his lead counsel, Ms. Trump, who is seeking the 2024 GOP presidential nomination, filed his suit in March against Clinton, who was the 2016 Democratic presidential nominee. Middlebrooks earlier dismissed the lawsuit against Clinton and all other defendants "with prejudice," which bars Trump from refiling the complaint.
